Client Agreement
Effective Date: August 27, 2025
1. Agreement Overview
These Terms and Conditions (“Agreement”) govern the relationship between Terzetto Construction (“Company,” “we,” “our,” or “us”) and our clients (“Client” or “you”) for residential and commercial construction services. By engaging our services, you agree to these terms.
2. Scope of Services
We offer a range of services, including:
Residential Construction: Custom homes, Barndominiums, vacation homes, and luxury estates.
Commercial Construction: Industrial facilities, fitness centers, and restaurant builds.
Design Services: Interior and plan design tailored to your vision.
Renovations and Remodels: Whole-home renovations, kitchen and bathroom remodels, and flooring and countertop installations.
3. Project Estimates and Payments
Estimates: All project estimates are based on initial consultations and may be subject to change based on design revisions or unforeseen conditions.
Payment Terms: Payment schedules will be outlined in the project agreement. Typically, payments are due as follows:
Deposit: A percentage of the total project cost before commencement.
Progress Payments: Based on project milestones.
Final Payment: Upon completion and client satisfaction.
Late payments may incur interest charges as specified in the agreement.
4. Client Responsibilities
Site Access: Provide us with access to the project site during working hours.
Permits and Approvals: Obtain necessary permits and approvals unless otherwise agreed.
Utilities: Ensure availability of utilities (water, electricity) at the site.
Communication: Maintain open communication and respond promptly to inquiries.
5. Change Orders
Any changes to the original scope of work must be documented through a written change order, signed by both parties. Additional costs or time extensions resulting from changes will be agreed upon before work proceeds.
6. Warranties
We provide warranties on our workmanship and materials as specified in the project agreement. These warranties do not cover damages resulting from misuse, neglect, or alterations by others.
7. Liability and Insurance
Insurance: We maintain appropriate insurance coverage for the duration of the project.
Liability: Our liability is limited to the total amount paid for the specific project, excluding indirect or consequential damages.
8. Termination
Either party may terminate the agreement with written notice if the other party breaches its obligations. Upon termination, the client is responsible for payment for work completed up to the termination date.
9. Dispute Resolution
In the event of a dispute, both parties agree to attempt resolution through mediation before pursuing legal action.
10. Governing Law
This Agreement is governed by the laws of the state in which the project is located.
